Deutsche Umwelthilfe 2026: Understanding the Litigation Strategy
The DUH as a key player: Deutsche Umwelthilfe (DUH, German Environmental Aid) has been the most active organisation with the right to sue in consumer and environmental law in Germany since 2010. It has successfully sued Lidl, Aldi, dm, Edeka, Shell and TotalEnergies.
Litigation Strategy 2026 — Q2 2026 (April-June): Focus on large chains in the food retail sector, preemptively before EmpCo comes into force. Q3 2026 (July-September): Focus on the energy and mobility sectors, strategic pilot proceedings. Q4 2026 (October-December): Nationwide warning letters after EmpCo comes into force.
Procedural Tactics: 1. Preliminary notice to the affected company (rarely 6-8 weeks’ notice). 2. Request a declaration of discontinuance with contractual penalty (typically €5,000-€25,000). 3. If refused: File a lawsuit with a value in dispute of €25,000-€100,000. 4. Accompanying press release as a means of exerting pressure.
DUH’s Success Statistics: 92% of proceedings are concluded with a declaration of discontinuance. 6% reach a court judgment (mostly in favour of DUH). 2% are withdrawn.
Realistic Risk Profile: Any brand with a turnover of >€10 million and advertising with generic environmental claims has an 8-12% probability per year of receiving a warning letter from the DUH. For prominent brands: 20-30%. The best defence: Prevention. An annual Empcora audit costs €49. A DUH warning letter costs an average of €12,500.
