EmpCo compliance for online shops

From 27.09.2026, all product pages must comply with EU greenwashing law. Existing products are affected. Fines of up to 4% of annual turnover. Here you will find the key risks, the shop checklist and integration options.

These five patterns show up in 80% of all shop audits. Sorted by severity of risk and with a concrete solution.

High

"Carbon-neutral shipping" on product pages

Reason: Per se prohibited without substantiation of the methodology (Annex I No. 4 EmpCo). Mere offsetting is not sufficient.

Solution: State DHL GoGreen Plus + offsetting evidence under ISO 14064-1, or remove the claim entirely.

"Sustainable packaging" without certification

Reason: Generic environmental claim without evidence. Breach of § 5b UWG (withholding material information).

Solution: State the FSC certificate number + recycled content as a percentage. Link the evidence directly on the product page.

Medium

"Organic" without the EU organic logo

Reason: Protected term under EU 2018/848. Use without certification is an unfair competition breach.

Solution: Apply for certification or avoid the term. Alternatives: "produced pesticide-free", "from extensive farming".

Vague "eco" or "green" in the product name

Reason: Misleading advertising under § 5 UWG. EmpCo prohibits generic environmental claims without a specific reference.

Solution: Be specific: "eco" → "made from 80% recycled plastic". Name the concrete benefit in the product title.

Self-created sustainability label

Reason: Trust labels without independent certification are explicitly prohibited from 09/2026 (Annex I No. 4a EmpCo).

Solution: Use only independent certifications (Blue Angel, EU Ecolabel, FSC, GOTS). Remove self-designed labels entirely.

  • Shipping options: "climate neutral" only with verified offsetting (ISO 14064-1)
  • Packaging choice: substantiate "sustainable packaging" with an FSC/PEFC certificate
  • Terms & conditions: avoid advertising "green" promises without substantiation

Marketing

  • Check newsletter templates for environmental claims
  • Social media ads: Meta + Google have required substantiation since 2026
  • Check affiliate copy and influencer briefings for compliance
  • Product photos: do not use generic environmental symbols without evidence

International shops

  • EmpCo applies EU-wide — DE/AT/FR/NL shops are all affected

Frequently asked questions from day-to-day shop operations

Do we have to change all existing products before 27.09.2026?

Yes. From 27.09.2026 EmpCo applies to ALL products available in the shop — including existing items with old descriptions. Empcora identifies risks centrally and prioritises by severity of breach.

Are dropshippers and marketplaces also affected?

Yes. Anyone who offers the product on the EU market is liable for the compliance of the product presentation — even if the advertising originates from the manufacturer. Marketplace operators (Amazon, Otto, Zalando) have required EmpCo conformity declarations from sellers since Q1 2026.

What specific fines do shops face?

Up to 4% of annual turnover (UWG-E § 19 in conjunction with EmpCo Art. 13). For a shop with €5m turnover, that means a potential €200,000. On top of this come cease-and-desist actions from competitors and consumer protection bodies (amounts in dispute of €5,000-50,000 per claim).

Can we use Empcora as a white label for our shop clients?

Yes. With the agency plan (€199/mo) you manage up to 20 domains for your clients and can export white-label PDFs with your logo. Multi-tenant management is included.

How often should a shop be scanned?

For an actively maintained range we recommend weekly scans (Monitoring Pro, €59/mo). For a static range, monthly (Monitoring Basic, €19/mo). New products should be scanned via the API immediately after being created.

Does Empcora also work for multilingual shops?

Yes. Empcora scans DE, EN, FR and NL natively. Other languages are checked via automatic translation of the terms found. A separate report is created per language.
