„Green Bond"
Regulation (EU) 2023/2631, § 5a Abs. 2 UWG
What does it mean?
The term "Green Bond" can only be used lawfully if the bond either complies with the EU Green Bond Standard (EuGB) pursuant to Regulation (EU) 2023/2631 of 22 November 2023 (in force since 21 December 2024) or with the ICMA Green Bond Principles with the involvement of an independent External Reviewer. Without such conformity and transparent disclosure, this constitutes a misleading commercial practice pursuant to § 5a Abs. 2 UWG. Accepted External Reviewers include, for example, Sustainalytics, Vigeo Eiris or ISS Corporate. In addition, Allocation and Impact Reports must be made publicly accessible in order to demonstrate the use of proceeds and the environmental impacts achieved.
