The EmpCo Directive defines four categories (so-called per-se prohibitions) in which the misleading nature is presumed by law and does not have to be proven on a case-by-case basis by the claimant. Climate-neutrality claims

"Climate-neutral", "CO₂-neutral", "net-zero" — blanket statements based exclusively on offsetting are fully prohibited from 27.09.2026.

What is the EmpCo Directive and when does it take effect?
EU 2024/825 — the "Empowering Consumers Directive" — prohibits blanket environmental claims without specific evidence across the entire EU from 27 September 2026. In Germany it is implemented through the UWG.
Who can issue a warning notice against me?
Competitors, qualified trade associations (IHK, Wettbewerbszentrale) and consumer-protection associations. A warning notice (Abmahnung) typically costs 1,000–5,000 € — a preliminary injunction considerably more.
How high are the fines really?
The EmpCo Directive provides for fines of up to a maximum of 4 % of annual turnover in the affected EU member state. For a mid-sized company with 10 million € in turnover, the statutory maximum would be 400,000 € per infringement — but the actual fine depends on the severity of the infringement, intent/negligence and repetition, and is determined case by case by the respective supervisory authority. In current UWG practice, sanctions for SMEs are typically well below that; more reliably calculable are the legal costs of warning notices (regularly in the four- to five-figure range).
Is it enough to simply remove "climate-neutral"?
Often not. Generic terms such as "sustainable", "green", "environmentally friendly" are affected too. In addition, meta tags, alt texts and PDFs must be checked — which is exactly what this tool exists for.
How does Empcora differ from a law firm?
